Applicable Terms and Conditions

The following terms and conditions (the ""Terms"") apply to all orders placed through the Amorati webshop. By ordering products on the Amorati webshop you accept these Conditions.

Amorati reserves the right to change these Terms at any time without prior notice.

Price

All prices on the Amorati webshop are expressed in euros including VAT and are exclusive of any costs for shipping and payment.

Sales contract

Purchases via the Amorati webshop are made when you have received a confirmation message that the order has been successfully processed and that payment has been received.

You acknowledge and agree to pay all shipping, payment and handling charges, as well as the payment of VAT and all other applicable taxes on your order. These costs are automatically calculated for you, clearly displayed when you place your order and debited from your account together with the total cost of the product.

Shipment

Amorati works with third parties for the shipment of your order. The costs of shipping depend on the shipping method you choose and the destination of your items. These costs are clearly displayed when placing your order through the Amorati webshop.

The shipping and delivery dates quoted are no more than ideal estimates and Amorati cannot be held responsible for any losses, damages, or charges caused by non-compliance with the specified shipping and delivery dates.

Offer

The articles are only intended for normal private use.

Despite the fact that the Amorati website and webshop are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. If you have specific questions, please contact our customer service (see below). Amorati is only bound by an obligation of means with regard to the correctness, updating or completeness of the information provided.

All products are delivered according to availability and can be canceled at any time. The Amorati webshop is automatically updated to always offer you the most recent products. However, it may happen that an item is not in stock. If the global delivery period, counting from the acceptance of the order, is more than 30 days, you will be contacted by our customer service.

Amorati is entitled, without stating reasons, to refuse orders, to adjust the delivery times, to split the deliveries, or to attach other conditions to the delivery.

Retention of title

The delivered items remain the exclusive property of Amorati until full payment has been made. However, the risk of loss or damage is transferred to you upon delivery. You undertake to inform third parties of Amorati's retention of title if necessary.

Guarantee

If the goods delivered by Amorati show shortcomings or turn out to be defective, they will be replaced free of charge by Amorati within the applicable warranty periods and conditions prescribed by Belgian law. Amorati then becomes the owner of the replaced good.

Right of withdrawal

You have the right to inform Amorati that you are canceling your purchase, without payment of a fine and without giving a reason, within 30 calendar days from the day following the delivery of the good.

If you wish to exercise your right to cancel your purchase, you must notify us in writing within 30 calendar days of delivery of your goods at the following address: Oude Jetseweg 1, 1731 Relegem-Asse, Belgium. The goods must be returned to Amorati at your expense within 30 calendar days from delivery at the following address: Oude Jetseweg 1, 1731 Relegem-Asse, Belgium.

Only articles that are in the original unopened and undamaged packaging, together with all accessories, inserts and invoice or proof of purchase, will be taken back. Used articles or articles of which the packaging (or part of it) has been opened will under no circumstances be taken back.

If you decide afterwards that you no longer wish to receive such e-mails, you can have yourself removed from the distribution list by clicking the ""unsubscribe"" link in the e-mail. Force of the majority

Amorati cannot be held liable for any loss or damage resulting from shortcomings, delays or non-compliance with obligations due to force majeure including strike, lockout, riot, war, fire, accident, shortage of the suppliers or manufacturers of the Amorati Material, governmental restrictions, non-granting of import or export licenses, violation of laws, regulations or orders, or for any other circumstances or causes that interfere with proper compliance with these Terms, or for any other cause beyond Amorati's control.

Complaints & Amorati customer service

Any defect, visible damage and / or qualitative shortcoming of an article or other shortcoming in the delivery must be reported within 30 calendar days from the day following the delivery of the good, under penalty of forfeiture of any right.

Infringement of validity & non-renunciation

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

The fact that Amorati does not require the application of any provision of these Terms or does not claim its rights under these Terms does not mean that Amorati waives its rights or remedies under these Terms.

Evidence

You accept that electronic communications, electronic signatures and backups may serve as evidence.

Applicable law and competent court
Belgian law is applicable, with the exception of the Belgian referral rules from Belgian international private law. In case of disputes, only the courts of Brussels have jurisdiction.
